1.4 The use of the website https://exclusiveportugalwines.com and the purchase of products presupposes the knowledge, understanding and acceptance of these Terms and Conditions by the User.

2.2 From the moment you access your personal account, the User is subject to these Terms and Conditions.

3. THE EPW PRODUCTS

3.1 The website https://exclusiveportugalwines.com is aimed at all users, of legal drinking age, who wish to purchase products on it, from their home or workplace, for 24 hours per day, 7 days a week.

3.3 EPW reserves the right to modify, at any time, the information, the offer of products, prices, promotions and commercial conditions, presented on the website https://exclusiveportugalwines.com

4. PLACE ORDERS ON THE WEBSITE

4.1 To order from https://exclusiveportugalwines.com, the User must be of legal drinking age and have an e-mail account and that your browser is configured to accept cookies and pops -ups, which will allow you to enjoy all the navigability conditions of the EPW online store.

4.1.1 The User may purchase products online, requiring that: a) Find the product(s) that he/she wishes to purchase; b) Add the selected product(s) to the "Shopping Cart"; c) Register the User's personal data, which will be included in the EPW database in accordance with the Privacy Policy, including the "Delivery Address", "Billing Address", the "Payment Method" , telephone number and tax identification number (TIN); d) Review your order and confirm the order;

4.2 You will receive an order confirmation email with details regarding the payment method you have selected.

4.3 Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the respective detailed invoice.

4.4 By submitting the order form, the User accepts the Terms and Conditions of purchase described at https://exclusiveportugalwines.com, as well as the Privacy Policy.

4.5 EPW reserves the right not to accept and cancel orders already confirmed in the following situations:

a) The product is not available;

b) The payment is not made using any of the payment options available on the website, https://exclusiveportugalwines.com;

c) Payment is not confirmed;

d) The billing information is not correct or verifiable;

e) There is an error in the price quotation;

f) It is not possible to deliver to the address provided by the User.

5. PRICES

5.1 The prices of products displayed on the website https://exclusiveportugalwines.com include Value Added (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User.

5.2 Prices are all quoted in euros (€). Please note that changing the country of delivery may have an influence on prices due to different shipping costs. Customs cost relating to the country of delivery of the order will be borne by the customer.

5.3 The prices of the products shown on the website are subject to change. EPW reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

5.4 If there is any error in the price of the requested products, EPW or the User may, until the order is dispatched, cancel the order.

5.5 The total price specified at the end of the order, includes imposts in the country of destination if it is an EU country (27 countries), or in the country of departure (Portugal) if outside the EU, and shipping costs.

5.6 The User must pay only the amount specified in the order confirmation.

6. PAYMENT METHODS

6.1 The User may pay for their purchases through the payment management entity PayPal, through Credit Card (Visa/Mastercard), through Multibanco Reference, MBWay (only Portugal), as well as bank transfer.

6.2 EPW does not accept any other payment method than those mentioned in the previous point. The User must not attempt to pay by any means other than the specified payment methods. If you do, we cannot be held responsible for loss of payment or any other damages that may result.

7. SHIPPING COSTS

7.1 The price of shipments can be found on the link on our home page "Shipments".

8. DELIVERY

8.1 EPW sends the product(s) ordered by the User, from Monday to Friday, from 10 am to 7 pm, except for holidays, on the days and times used by the logistics company, to the delivery address indicated by the User.

8.2 The delivery service does not include advance scheduling option, so the delivery of the order will be made by contacting the carrier on the day of delivery (via SMS or phone call), it is necessary to ensure that someone is at the address of destination. If delivery is not possible, a pickup note will be left in the mailbox or a message on the mobile phone for the user to later pick up the order at a collection point near the destination address.

8.3 Delivery times vary depending on the country of destination. You can check this estimate on the link on the homepage "Shipments".

8.4 Upon delivery, the User must inspect the packaging to check for any damage. If you find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via our e-mail. If you agree, EPW will resend the order at no cost to the User. If the User wishes to cancel the order, the full amount paid will be returned to him.

8.7 If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of the order, please send an email informing us of the event. After this period, EPW cannot be held responsible for the loss of the order. 8.8 Delivery is considered to be made with the signature on the delivery receipt at the agreed address.

9. RIGHT OF FREE RESOLUTION

9.1 The User may terminate his contract within 14 (fourteen) days after receiving the order, provided that:

a) The product(s) have not been used;

b) The product(s) keep their original characteristics and labels intact;

c) The product(s) are complete. All material accompanying orders must be returned.

9.2 The User may exercise his right of free termination by sending the Free Termination template or any other unequivocal declaration of termination of the contract to our e-mail.

9.3 The costs of returning the order in exercising the right of free withdrawal are borne by the customer.

9.4 Once the returned product has been received, EPW will analyze and confirm the state of conservation of the order and, where applicable, will refund within a maximum period of 15 (fifteen) days the amounts paid by the User contained in the order, through the same means used to pay for the order.

9.5 If returned items show signs of use, EPW reserves the right not to accept the return and to refuse refunds.

9.6 The User should note that, if the return has been made for reasons apart from the justified existence of a defect or non-conformity of the ordered products, EPW will not reimburse the shipping costs. Therefore, EPW will not reimburse the expenses related to the postage initially borne by the customer for the respective order.

10. CANCELLATIONS AND RETURNS

10.1 The User may cancel his order, as long as he requests it through our e-mail before sending it.

10.2 If the order has been received before shipping, we will refund the amounts paid by the User included in the order, through the same means used for payment of the order, within a maximum period of 15 (fifteen) days.

10.3 If the request has been received after submission, the rules contained in the previous chapter, relating to the right of free withdrawal, will apply.

10.4 EPW does not offer direct exchanges. The User may opt for a voucher to exchange their order for another item available on the website, being responsible for all costs relating to the new shipment. Please note that orders placed with a voucher and later returned can only receive a new voucher as a refund.

10.5 In case the ordered product is found to be defective or other non-conformity, the User may choose to: a) replace the product; b) terminate the contract.

10.6 As soon as the User finds a defect or other non-conformity of the product, he must notify us through our e-mail, sending supporting photographs.

10.7 Once we receive your email, we will contact you to resolve the issue by consensus. 10.8 In any of the options exercised by the User, pursuant to 10.6, the respective costs will always be borne by EPW.

11. QUALITY

EPW does not sell second-hand, defective or inferior quality products.

13. WARRANTY AND AFTER SALES SERVICES

EPW products benefit from the guarantee of compliance provided for in the legislation applicable to the sale of consumer goods.

14. EXCLUSION AND LIMITATION OF LIABILITY

EPW does not guarantee the uninterrupted operation of the website https://exclusiveportugalwines.com, or any of its functionalities, and it may be suspended for maintenance, repair or updates.

EPW shall likewise not assume any responsibility for any damages, arising directly or indirectly from force majeure situations that prevent EPW, in any way, from fulfilling its obligations, namely, strikes, failures in the electrical network, in telecommunications services or in any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.

EPW is not responsible for any misuse of the User's access data to the website by third parties, as they are personal and non-transferable.
